Welcome to DIYA Research ("DIYA," "we," "us," or "our"). These Terms and Conditions ("Terms") govern (1) your access to and use of our website and (2) registration for and participation in our online programs, events, and services (collectively, the "Services"). By using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

1. About DIYA Research

DIYA Research is a California nonprofit organization providing educational programs in artificial intelligence, data science, and research for K–12 students, professional development for educators, and learning pathways for professionals.

2. Acceptance of Terms and Parent/Guardian Responsibility

  • By using the Services, you confirm that you have read, understood, and agree to these Terms.
  • Participants under 18: A parent or legal guardian must review and accept these Terms on the participant's behalf and is responsible for the participant's compliance.
  • You represent that the information you provide during registration is accurate and complete.

3. Program Registration and Enrollment

Eligibility

Program eligibility requirements (including grade level, prerequisites, and technical requirements) are listed on each program page. Participants must meet the stated requirements.

Registration Process

  • Registration is completed through our online registration form.
  • For student programs, parent/guardian contact information and required consents must be provided.
  • Registration is subject to availability and acceptance by DIYA.

Enrollment Confirmation

Enrollment is not complete until you receive a confirmation email and payment is successfully processed (if the program is paid). We may refuse enrollment or cancel registration in limited circumstances, including safety, eligibility, or administrative reasons.

Prerequisites

Some programs require prerequisite knowledge (for example, Python programming). Participants are responsible for confirming they meet prerequisites. Misrepresentation may result in removal from the program without refund.

4. Payment Terms

Program Fees

Program fees are listed on each program page and must be paid in full at registration unless otherwise stated. All fees are in U.S. Dollars (USD).

Payment Methods and Processing

We accept credit and debit card payments through our payment processor (Stripe). Payment is processed at registration submission. You will receive a receipt/confirmation by email.

Failed Payments

If payment fails, enrollment will not be confirmed. Contact info@diyaresearch.org for assistance.

Discount Codes

Discount codes may be offered for certain programs. Codes:

  • Are valid only during stated promotional periods
  • May not be combined unless explicitly stated
  • Are non-transferable and not redeemable for cash

DIYA may modify or discontinue codes at any time.

5. Cancellation and Refund Policy

Refund Deadline (Program-Specific)

Each program page includes an FAQ section with a Refund Deadline date.

Cancellation by Participant

  • On or before the Refund Deadline: Full refund minus a $75 administrative fee.
  • After the Refund Deadline: No refunds

To request a cancellation/refund, email info@diyaresearch.org with the participant name, program name, and registration email.

Cancellation by DIYA

We may cancel a program due to insufficient enrollment, instructor unavailability, or unforeseen circumstances. If DIYA cancels a program, you will receive a full refund of fees paid for that program.

Refund Processing

Refunds are issued to the original payment method. Processing times depend on the payment processor and financial institutions.

No-Refund Circumstances

Refunds are not provided for: (1) failure to attend, (2) dissatisfaction with program content, (3) removal due to Code of Conduct violations, or (4) participant-side technical issues (internet/device/software).

6. Online Program Participation and Technical Requirements

All programs are delivered online. Participants are responsible for ensuring:

  • Reliable internet connection
  • A compatible device and updated browser/software
  • Required tools installed before the program start date
  • A learning environment suitable for participation

DIYA is not responsible for disruptions caused by participant equipment, connectivity, or third-party outages.

7. Code of Conduct and Safety

All participants must:

  • Treat instructors, staff, and participants respectfully
  • Use appropriate language and behavior
  • Refrain from harassment, bullying, discrimination, or disruptive conduct
  • Follow academic integrity expectations and respect intellectual property
  • Follow instructor and program guidelines

DIYA may take action to maintain a safe learning environment, including warnings, removal from sessions, dismissal from a program, or restriction from future participation. Removal for misconduct may be without refund.

8. Recording of Online Sessions (Program Operations)

DIYA may record online sessions for legitimate program purposes, such as educational delivery, participant support, instructor training, safety, and quality improvement. Recordings may capture participant audio, video, chat messages, and shared screens.

  • By enrolling/participating, you consent to being recorded for these purposes.
  • For participants under 18, the parent/guardian provides this consent on the participant's behalf.
  • If you have concerns about being recorded, contact info@diyaresearch.org before the program begins. DIYA may offer reasonable options (for example, camera off), but some program components may require participation features that cannot be fully anonymized.

9. Optional Media Release for Promotion (Separate Permission)

DIYA may request an optional, separate opt-in permission ("Media Release") that allows DIYA to use certain participant media for communications and promotion.

What may be used (only if opted in)

  • Participant name (or first name/initial), likeness, image, voice, and/or video
  • Photos, screenshots, or recordings from sessions or showcase events
  • Participant-created work (for example, slides, demos, code excerpts, posters, project summaries)

Where it may be used

DIYA websites, newsletters, social media, grant/fundraising materials, and other DIYA communications.

Parent/Guardian consent for minors

Participants under 18 may be included in promotional media only with parent/guardian opt-in permission.

Revoking permission

A parent/guardian (or an adult participant) may revoke the Media Release for future use by emailing info@diyaresearch.org. Revocation applies prospectively. DIYA will make reasonable efforts to stop future use and to remove content from DIYA-controlled channels when feasible.

If you do not opt in, DIYA will not use identifiable participant media for promotional purposes.

10. Intellectual Property

Program Materials

All program materials (curriculum, lesson plans, slides, videos, datasets, templates, and code examples) are owned by DIYA or its licensors and protected by intellectual property laws.

License to Use

Enrolled participants receive a limited, non-exclusive, non-transferable license to access and use program materials for personal educational purposes. Participants may not:

  • Share, distribute, publish, or sell program materials without written permission
  • Record live sessions without explicit instructor permission
  • Use materials for commercial purposes
  • Create derivative commercial works from program materials without permission

Student Work

Participants retain ownership of original work they create. If a participant (or parent/guardian for minors) opts into the Media Release, DIYA may showcase the student's work as described in Section 9. If not opted in, DIYA may still reference de-identified or aggregated examples (for example, describing project themes) without identifying the student.

11. Privacy and Data Protection

DIYA handles personal information in accordance with our Privacy Policy. By registering, you consent to information use necessary to deliver programs (for example, sharing limited information with instructors and program administrators).

12. Third-Party Services and Platforms

DIYA may use third-party platforms (such as Zoom, Stripe, email delivery services, and learning tools) to operate programs. Your use of those services may be subject to their separate terms and privacy practices. DIYA is not responsible for third-party platform outages or disruptions.

13. Disclaimers

DIYA programs are educational. DIYA does not guarantee specific outcomes, including grades, admissions, scholarships, employment, publication, or recognition.

The website and programs are provided "as is" and "as available," without warranties of any kind, except where warranties cannot be excluded under applicable law.

14. Limitation of Liability

To the maximum extent permitted by law, DIYA and its directors, officers, employees, instructors, and volunteers are not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Services.

DIYA's total liability for any claim relating to a specific paid program will not exceed the amount paid for that program.

15. Indemnification

You agree to indemnify and hold harmless DIYA and its representatives from claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (1) your violation of these Terms, (2) your misuse of program materials, (3) your content or conduct during programs, or (4) your infringement of another party's rights.

16. Changes to Programs and Services

DIYA may modify curriculum, schedules, instructors, or delivery format as needed. If a change materially affects a program, DIYA will provide reasonable notice to enrolled participants when practicable.

17. Dispute Resolution, Governing Law, and Venue

Before filing a formal claim, contact info@diyaresearch.org to attempt to resolve the issue informally.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

Venue and Jurisdiction

Any legal action arising from these Terms or the Services shall be brought in the state or federal courts located in California, and you consent to personal jurisdiction and venue in those courts.

18. Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in effect. The provision will be modified to the minimum extent necessary to make it enforceable.

19. Entire Agreement

These Terms, together with the Privacy Policy and any program-specific requirements posted on the program page, form the entire agreement regarding the Services and supersede prior understandings on the same subject.

20. Changes to These Terms

DIYA may update these Terms from time to time. Updates will be posted with a revised "Last Updated" date. For enrolled participants, the terms in effect at the time of registration generally apply unless changes are required by law or are administrative.
